Confidentiality

General Information

It is important for you to understand that in situations where there may be potential harm to yourself or others, or if the law demands it, we have a duty of care to disclose information disclosed during session. Also if your treatment records are subpoened by a Court, those records must be provided.

Your psychologist must abide by a code of confidentiality in keeping client records and when they are required to disclose certain information discussed during session. In doing so your psychologist may disclose confidential information obtained in the course of their provision of psychological services only under any one or more of the following circumstances:

(a) with the consent of the you the client, or a person with legal authority to act on your behalf;

(b) where there is a legal obligation to do so (e.g. Court order/subpoena);

(c) if there is an immediate and specified risk of harm to any person or persons (client or others) that can be averted only by
disclosing information; or

(d) when consulting colleagues, or in the course of supervision or professional training, provided that your psychologist:

  • conceals your identity and any associated parties involved;
  • obtains the your consent, and gives prior notice to the recipients of the information that they are required to reserve your privacy, and obtains an undertaking from the recipients of the information that they will preserve the your privacy.


It is important that you also be aware that where your attendance at Stephens & Bradley is for the purposes of court reports, or workcover treatment of injuries etc, there are limits to what information is confidential. You should speak to your treating psychologist for specific clarification of the limits to confidentiality in these areas.
